These general conditions concern the sale of various products through the store.hardcoreitalia.it website and related domains owned by the Seller.
All contracts will be concluded directly through access by the Customer/User to the Internet site corresponding to the address store.hardcoreitalia.it, where the Customer will be able to conclude the contract for the purchase of the desired product by carefully following the instructions and planned purchasing procedures.
These general conditions of sale must be examined online by the Customer, before completing the purchase procedure. The forwarding of the order confirmation therefore implies total knowledge of the same and their full acceptance.

COMPANY RESPONSIBILITY
The Seller is responsible only for the management of online orders, operates in compliance with Italian law and for any dispute refers to the Court of Busto Arsizio. For the consumer, the court of the place where the user resides or has chosen domicile will be competent.
Purchase operations are governed by Italian law, in particular by Legislative Decree 6 September 2005 n. 206 “CONSUMER CODE” and by Legislative Decree 9 April 2003, n. 70 “E-COMMERCE DECREE”.
All the information contained within the portal and related proprietary domains comply with Italian legislation, therefore their conformity with the legislation of other foreign countries is not guaranteed. The Seller is not responsible for any loss of data, malfunctions of services, etc., attributable to:
– Incorrect use of the portal by the User
– Deactivation of cookies in the User's browser
– Failure by the User to use/install suitable antivirus and protection systems on their Internet browsing device.
The Seller reserves the right to modify its web portal whenever it deems necessary, rectifying and re-examining the contents published within it, including these terms and conditions of use of the portal and information to the Customer.
All Customers/Users are advised to pay attention to any updates to the portal and to periodically check for any changes in the conditions of use and legal terms.

All contents relating to the items available for sale have been provided and authorized by the manufacturing and/or distributing companies.
Product prices, descriptions and availability are specified in the respective sections of this Website and are subject to change without notice.
Although the products on this Website are presented with the greatest accuracy technically possible, the representation on this Website by any means (including, as the case may be, graphic materials, images, colors, sounds) is intended for reference only and not implies no guarantee regarding the characteristics of the product purchased. The images and colors of the products may not correspond to the real ones due to the Internet browser and monitor used. The characteristics of the selected product will be specified during the purchase procedure.
PURCHASE PROCEDURE
Each phase, from choosing the product to placing the order, is part of the purchasing procedure. The purchase procedure includes the following steps:
- Users are asked to choose the desired product and verify their purchasing choice.
- After checking the information visible in the purchase choice, Users can place the order by forwarding it.
SENDING THE ORDER
Sending the order involves the following:
- Sending the order by the user determines the conclusion of the contract and gives rise to the User's obligation to pay the price, taxes and any further charges and expenses, as specified on the order page.
- In the event that the purchased product requires an active contribution from the User, such as the provision of information or personal data, specifications or special requests, the forwarding of the order also constitutes the obligation of the User to collaborate consequence.
- Once the order has been submitted, the User will be sent a confirmation of receipt of the order. All notifications relating to the purchase procedure described above will be sent to the email address provided by the User for this purpose.
PRICES
During the purchase procedure and before placing the order, the User is duly informed of all commissions, taxes and costs (including any shipping costs) that will be charged to him. The prices on this Website include all applicable fees, taxes and charges.
PAYMENT METHODS
The details relating to the accepted means of payment are highlighted during the purchase procedure (by credit card (via Stripe), PayPal and by bank transfer).
In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to Stripe, which provides the relevant electronic payment services to distance, without third parties being able to have access to it in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to the purchase and to issue the relevant refunds in the event of any product returns. In the event that the payment made by one of the available means fails or is rejected by the payment service provider, the Seller is not obliged to execute the order.
Any costs or fees resulting from failed or rejected payments are the responsibility of the User.
RETENTION OF TITLE
Until payment of the full purchase price is received by the Seller, the User does not acquire ownership of the Products ordered.
DELIVERY
Deliveries are made to the address indicated by the User and in the manner indicated in the order summary.
At the time of delivery, Users must check the contents of the package and promptly report any anomalies to the contact details indicated in this document or as described in the delivery note. Users may refuse to accept the package if it is visibly damaged.

DELIVERY FAILURE
The Seller is not responsible in any way for any delivery errors resulting from inaccuracies or omissions committed by the User in completing the purchase order.
In the event that the goods are not delivered or collected at the time or within the established deadline, they will be returned to the Seller, who will contact the User to schedule a second delivery attempt or agree on further measures.
Unless otherwise specified, any delivery attempt starting from the second will be at the User's expense.
RIGHT OF WITHDRAWAL
Pursuant to art. 52 and following of the Legislative Decree. n. 21 February 21, the Customer can exercise the right of withdrawal, returning the goods received and obtaining a refund of the price paid.
The buyer can exercise the right of withdrawal if for any reason he is not satisfied with the purchase made within 14 working days starting from the day of receipt of the purchased good.
Withdrawal method: To exercise the right of withdrawal, the Customer must, within the period indicated above, send us a registered letter with return receipt, or communication via e-mail to the e-mail address orders@hardcoreitalia.it.
This communication must contain all the data necessary to identify the order and the buyer, the indication of the product/products for which it is intended to exercise the right of withdrawal, a copy of the sales document accompanying the goods received (for products already delivered).
The Seller will carry out the necessary checks on the returned goods, reserving the right to verify that the products have been returned in their original state and with the original packaging; in this case he will refund the amount paid by the consumer for the purchase of the products with the exception of shipping costs.
Form for exercising the right of withdrawal (annex B to the Legislative Decree pursuant to art. 49, paragraph 1, letter h):

REFUND
In the event that the Customer opts for a refund of the order, Genesis Industries Srl will carry out the same in the following ways:
- For orders paid by credit card (Stripe), the transaction will be immediately canceled from the Seller's account. The waiting period for crediting varies depending on the issuing circuit of the card used for payment.
- For orders paid via PayPal, an immediate refund will be made to the Customer's Paypal account.
- For orders paid by bank transfer, the Customer will provide Genesis Industries Srl with its banking support in order to proceed with the refund. In all cases of returns, the Seller has the right to withhold the refund until the goods have been correctly delivered to the departure warehouse.
CAUSED AS A RESULT OF TOTAL OR PARTIAL DAMAGE
In the event that the Customer, upon checking the items delivered, finds manufacturing defects, damage or an error in sending the item compared to what was ordered, he has the right within 10 days to request a free return of the non-compliant goods. by sending an email communication with a return request to the address provided in the contacts, indicating in the communication the reference to the order number, code and description of the item to be returned and detailed reason.
In the event of damage or manufacturing defects, the sending of accompanying photographic documentation is required to identify the non-conformity. This will be followed by communication of the Return Authorization to the customer and a waybill for collection of the goods at the customer's address.
RETURN SHIPPING
Returns due to damage/manufacturing defect/non-compliance with the order are totally free.
Returns following exercise of the right of withdrawal are the sole responsibility of the Customer.
In all cases, the goods must be returned in their original packaging, which is considered to all intents and purposes an integral part of the product and must not have been damaged or used as the sole packaging for shipping. In the case of returns of clothing and accessories, it is a fundamental condition that the items have not been worn, washed or in any case do not show any signs of use. All items must be returned complete with the original label and accessories received with the order.
Failure to comply with the aforementioned return instructions will result in non-acceptance of the same. All returns will be sent directly from the Customer's address to the manufacturing company's warehouse by triangulation with express courier. The conditions of the goods will then be checked.
Once the return has been accepted, the Customer can choose to:
- Receive the product compliant with the order (in case of return due to damage/manufacturing defect/wrong item)
- Request a refund of the order for the value of the goods
GUARANTEES PROVIDED BY THE CUSTOMER
The Customer guarantees, assuming all inherent responsibility and holding the Seller harmless from any prejudicial consequences, that their data, provided upon acceptance of these general conditions, are truthful and allow the true identity of the Customer to be identified who also undertakes to immediately inform the Seller in written form, including by e-mail, of any change in the data provided.
At the time of registration, the Customer is given an identification code (User Name) and a keyword (Password) whose combined use will identify the Customer and allow the latter to make online purchases on the site. The Customer is therefore informed of the fact that purchase orders issued through the joint use of the Username and Password are valid and binding and that the availability of both by third parties would allow the latter to issue regular orders that bind the Customer, identified by Username and Password, to accept receipt of the ordered goods and to pay the amount due.
The Customer is therefore required to keep both the identification code and the password with the utmost diligence, keeping them both secret for the entire duration of the relationship with the Seller.
The Customer is also informed of the need to communicate to us a valid e-mail address in order to allow the Seller to forward order confirmations and any communication.
PROTECTION OF PERSONAL DATA
Genesis Industries Srl, owner of the brand Hardcore Italia, guarantees the Customer that the personal data acquired in relation to the sale of the products will always be processed lawfully and correctly, in full compliance with the provisions of EU Regulation 2016/679 and the applicable national legislation.
